By accessing or using Embersent ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Embersent is a document tracking platform that allows users to upload documents, generate tracked links, and view engagement analytics. The Service is hosted in the EU and operates without cookies or consent banners for recipients.

3. Eligibility

You must be at least 18 years of age and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately via our contact form of any unauthorized access.

5. Acceptable Use

You agree not to use the Service to distribute illegal, harmful, or infringing content, or to engage in any activity that disrupts the integrity or performance of the Service. We reserve the right to suspend or terminate accounts that violate this policy.

6. Intellectual Property

Documents you upload remain your property. You grant Embersent a limited license to store and process them solely for the purpose of providing the Service. Embersent's software, branding, and technology remain our exclusive property.

7. Payments and Subscriptions

Paid plans are billed monthly or annually as selected. Prices are shown exclusive of VAT; EU customers will see VAT applied at checkout. Subscriptions renew automatically until cancelled. Refunds are handled on a case-by-case basis — contact us within 14 days of a charge.

8. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted, error-free operation.

Embersent uses automated malware scanning as a best-effort security measure. No scanner detects 100% of threats. Embersent does not guarantee that all uploaded files are free of malicious content.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Embersent shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service.

Embersent is not liable for any damages arising from malicious content that passes through the scanning process, including but not limited to data loss, system compromise, or business interruption.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be communicated via email.

12. Governing Law

These Terms are governed by the laws of the Netherlands. Disputes shall be subject to the exclusive jurisdiction of the courts of Amsterdam.
